Tenant Waiting List™ (“we,” “us,” “our,” or the “Service”) is a tenant matching and referral platform provided under the supervision of Exzel Realty LLC, an Arizona licensed real estate brokerage (License # LC702479000), in affiliation with WealthWise Realty & Management, LLC. These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you,” “User,” “tenant,” “landlord,” “property manager,” or “owner”) and Exzel Realty LLC (the “Broker”) governing your access to and use of the Tenant Waiting List™ website, services, matching features, and related offerings (collectively, the “Services”).
By accessing, signing up for, or using the Services (including as a tenant joining the free waiting list or as a landlord/property manager listing properties or receiving leads), you agree to these Terms. If you do not agree, do not use the Services.
1. Eligibility and Accounts
- You must be at least 18 years old and legally capable of entering contracts to use the Services.
- By signing up, you represent that all information you provide is accurate, current, and complete.
- We may suspend or terminate accounts for violations, fraud, or at our discretion.
2. Description of Services
- For Tenants: The Services provide a free waiting list where you can submit housing preferences (e.g., location in Pima County/Tucson metro areas such as Tucson, Marana, Oro Valley, Sahuarita, Vail, etc.). We match you to participating rental properties (new builds, single-family homes, etc.) and may offer a $75 discount off the first month’s rent on successful placements (applied via agreement with the landlord/property manager).
- For Landlords/Property Managers/Owners: We provide pre-qualified tenant leads/matches. You handle background checks, approvals, leasing, and compliance with the Arizona Residential Landlord and Tenant Act (A.R.S. §§ 33-1301 et seq.). Upon successful placement, we charge a flat fee of $375, as detailed in separate onboarding agreements.
- All real estate brokerage activities (e.g., tenant procurement, referrals, placement fees) are conducted under the broker Exzel Realty LLC’s license. We do not perform screenings, negotiate leases, or enter into rental agreements.
3. User Conduct and Responsibilities
- You agree not to: misuse the Services, provide false information, harass others, violate laws, or interfere with operations.
- Tenants: Provide accurate preferences; the $75 rent discount is a benefit only if redeemed per landlord agreement.
- Landlords/Property Managers: Comply with all fair housing laws, ARLTA, and disclose terms clearly. You are solely responsible for leases, maintenance, and tenant relations.
- Prohibited: Discriminatory practices, spam, unauthorized data scraping.
4. Fees and Payment
- Tenants: Joining and using the waiting list is free. The $75 rent discount is not guaranteed and depends on placement and landlord participation.
- Landlords/Property Managers: No upfront fees to join or list. Placement fee is $375 is due only on successful tenancy and is outlined in written agreements. Fees comply with Arizona licensing rules (A.R.S. § 32-2155).
- All fees are non-refundable except as specified in agreements.
5. Intellectual Property
- The Services, content, logos (including Tenant Waiting List™), and materials are owned by us or licensed to us. You receive a limited, non-exclusive license to use for personal/non-commercial purposes.
- You grant us a license to use any content you submit (e.g., preferences) for Service operations.
6. Disclaimers and Limitations of Liability
- Services are provided “as is” without warranties. We do not guarantee matches, placements, tenant quality, or outcomes.
- We are not responsible for landlord/tenant disputes, property conditions, or lease terms.
- To the fullest extent permitted by law, our liability is limited to direct damages not exceeding fees paid (if any) in the prior 12 months. We are not liable for indirect, consequential, or punitive damages.

In addition to the above, we expressly disclaim any duty or obligation to review, vet, inspect, or ensure the safety, habitability, code compliance, or condition of any listed properties or the qualifications of any landlords/property managers. Landlord remains solely responsible for all such matters under applicable law. We shall not be liable for any claims related to property condition, safety issues, housing code violations, or Landlord representations/omissions.
7. Indemnification
You agree to indemnify and hold us harmless from claims arising from your use of the Services, your listings/matches, violations of these Terms, or your interactions with others.
8. Termination
We may terminate or suspend access at any time for violations or convenience. Upon termination, your account and data may be deleted (subject to retention for legal purposes).
9. Governing Law, Dispute Resolution, and Arbitration
- These Terms are governed by the laws of the State of Arizona, without regard to its conflict of laws principles.
- Informal Resolution: Before initiating any formal dispute resolution, you and we agree to attempt to resolve any dispute informally by providing written notice of the claim (including a detailed description and proposed resolution) to the other party. We will respond within 30 days.
- Binding Arbitration: Except for small claims court actions (if eligible) or claims seeking injunctive relief for intellectual property infringement, any dispute, claim, or controversy arising out of or relating to these Terms, the Services, or the breach thereof (including any question regarding the existence, validity, or termination of these Terms) shall be settled by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules (or Commercial Arbitration Rules if the claimant is a business entity like a landlord/property manager), as applicable. The arbitration shall take place in Pima County, Arizona (or virtually if mutually agreed). Judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction.
- Class Action Waiver: You and we agree that any arbitration or other proceeding shall be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate as a class member or in any multi-party proceeding.
- Arbitration Fees: Each party bears its own costs and attorneys’ fees, except as otherwise provided by applicable law or AAA rules. If you are a consumer and the claim is under a certain threshold, we may cover certain filing fees per AAA guidelines.
- Opt-Out: You may opt out of this arbitration provision within 30 days of first accepting these Terms by sending written notice to [Insert Address/Email, e.g., Exzel Realty LLC, Attn: Arbitration Opt-Out, [Address]].
- This arbitration provision survives termination of these Terms and is enforceable under the Arizona Revised Uniform Arbitration Act (A.R.S. §§ 12-3001 et seq.) and the Federal Arbitration Act where applicable.
10.Force Majeure
Neither party shall be liable for any delay or failure to perform any obligations under these Terms (except payment obligations) if such delay or failure results from causes beyond its reasonable control and without its fault or negligence, including but not limited to: acts of God (e.g., fire, flood, earthquake, storm, hurricane, or other natural disasters); acts of war, terrorism, sabotage, or civil unrest; epidemics, pandemics, or public health emergencies; government orders, laws, regulations, or restrictions; strikes, lockouts, or other labor disturbances (excluding those involving the party’s own employees); shortages of materials, energy, or transportation; or other similar events or circumstances (“Force Majeure Event”). The affected party shall: (i) promptly notify the other party in writing of the Force Majeure Event and its expected impact; and (ii) use commercially reasonable efforts to mitigate the effects and resume performance as soon as practicable. If a Force Majeure Event continues for more than 60 consecutive days, either party may terminate these Terms upon written notice without further liability (except for accrued obligations).
Changes to Terms
We may update these Terms. Continued use after changes constitutes acceptance. Check this page periodically.
11. Miscellaneous
- Entire Agreement: These Terms, plus our Privacy Policy and Legal Disclosures, form the full agreement.
- Severability: Invalid provisions do not affect the rest.
- No Waiver: Failure to enforce does not waive rights.
