Terms of Service

Tenant Waiting List™ (“we,” “us,” “our,” or the “Service”) is a tenant matching and referral platform operated by Tenant Waiting List LLC, an Arizona limited liability company wholly owned by WealthWise Realty & Management, LLC. All real estate brokerage activities (tenant procurement, referrals, and placement services) are conducted under the supervision of Exzel Realty LLC, an Arizona licensed real estate brokerage (License # LC702479000), in affiliation with WealthWise Realty & Management, LLC. These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you,” “User,” “Tenant,” “Landlord,” “Property Manager,” or “Owner”) and Tenant Waiting List LLC (the “Company”) governing your access to and use of the Tenant Waiting List™ website, services, matching features, and related offerings (collectively, the “Services”).
By accessing, signing up for, or using the Services (including as a tenant joining the waiting list or as a landlord/property manager receiving leads), you agree to these Terms. If you do not agree, do not use the Services.
1. Eligibility and Accounts • You must be at least 18 years old, have the legal capacity to enter into contracts in the State of Arizona, and be legally capable of entering rental agreements. • By signing up, you represent and warrant that all information you provide is accurate, current, and complete. You agree to update your information promptly if it changes. • We may suspend or terminate your account at any time for violations of these Terms, suspected fraud, misuse, or for any other reason at our sole discretion.
2. Description of Services • For Tenants: The Services provide a free waiting list where you may submit your housing preferences (e.g., location within Pima County/Tucson metro areas including Tucson, Marana, Oro Valley, Sahuarita, Vail, etc.). We facilitate matches to participating rental properties. Any rent discount off the first month’s rent is offered solely at the discretion of the participating landlord or property manager and is applied only upon successful lease execution after the landlord or property manager completes their independent screening and approves you. The Tenant Waiting List™ does not perform any tenant screening, credit checks, background checks, or approvals. • For Landlords, Property Managers, and Owners: We provide profiled tenant leads and matches. You are solely responsible for conducting all screenings, background checks, approvals, leasing, compliance with the Arizona Residential Landlord and Tenant Act (A.R.S. §§ 33-1301 et seq.), fair housing laws, and all other legal obligations. All real estate brokerage activities (tenant procurement, referrals, and placement fees) are conducted under the supervision of the licensed broker, Exzel Realty LLC. We do not perform screenings, negotiate leases, manage properties, or enter into rental agreements. • We do not guarantee any matches, placements, approvals, discounts, or outcomes.
3. User Conduct and Responsibilities • You agree not to misuse the Services, provide false information, harass others, violate any laws (including fair housing laws), or interfere with platform operations. • Tenants: Provide accurate preferences. The rent discount is conditional and depends entirely on the landlord’s or property manager’s participation and your approval by them. • Landlords/Property Managers/Owners: Comply with all applicable laws, including the Arizona Residential Landlord and Tenant Act (ARLTA), fair housing laws (federal and state), and disclose all material terms clearly. You are solely responsible for leases, providing any agreed rent discount, property maintenance, habitability, and tenant relations. • Prohibited conduct includes discriminatory practices, spam, unauthorized data scraping, or any violation of Arizona real estate licensing rules.
4. Fees and Payment • Tenants: Joining and using the waiting list is free. Any rent discount is not guaranteed and is provided solely by the participating landlord or property manager. • Landlords/Property Managers/Owners: There are no upfront fees to join or list properties. A placement/referral service fee is charged only upon successful tenancy (lease execution after your independent screening and approval) and is governed by a separate written placement agreement. All fees comply with Arizona law, including A.R.S. § 32-2155 and related ADRE rules on compensation and disclosures. Fees are non-refundable except as expressly stated in the separate agreement. • All compensation for brokerage services is paid to and handled through the licensed broker, Exzel Realty LLC.
5. Intellectual Property • The Services, content, logos (including “Tenant Waiting List™”), and materials are owned by us or licensed to us. You are granted a limited, non-exclusive, revocable license to use the Services for personal or authorized business purposes only. • By submitting content (e.g., preferences or property details), you grant us a worldwide, royalty-free license to use it for operating, improving, and promoting the Services (including anonymized data for market insights).
6. Disclaimers and Limitations of Liability • The Services are provided “AS IS” and “AS AVAILABLE” without any warranties, express or implied. We do not warrant matches, placements, tenant quality, property conditions, or any outcomes. • We do not screen tenants or properties. We expressly disclaim any duty or obligation to review, vet, inspect, or ensure the safety, habitability, code compliance, or condition of any properties or the qualifications of any users. • We are not responsible for any landlord-tenant disputes, property conditions, lease terms, or interactions between users. • To the fullest extent permitted by Arizona law, our total liability to you is limited to the greater of (i) the fees you paid to us in the prior 12 months or (ii) $100. We are not liable for indirect, consequential, incidental, punitive, or exemplary damages. • Tenants are strongly encouraged to conduct their own due diligence, inspections, and independent verification before signing any lease.
7. Indemnification You agree to indemnify, defend, and hold harmless Tenant Waiting List LLC, WealthWise Realty & Management, LLC, Exzel Realty LLC, and their affiliates, officers, agents, and employees from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from: (i) your use of the Services; (ii) your listings, matches, or interactions with other users; (iii) your violation of these Terms or applicable law; or (iv) any content you submit. This indemnification survives termination of these Terms.
8. Termination We may terminate or suspend your access at any time, with or without cause. Upon termination, your account and data may be deleted, subject to legal retention requirements. Pending leads or vouchers may be canceled.
9. Governing Law, Dispute Resolution, and Arbitration • These Terms are governed by the laws of the State of Arizona, without regard to conflict of laws principles. • Informal Resolution: Parties agree to attempt informal resolution by providing written notice of any claim (with details and proposed resolution). We will respond within 30 days. • Binding Arbitration: Any dispute arising out of or relating to these Terms or the Services shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its applicable rules (Consumer or Commercial) in Pima County, Arizona (or virtually if agreed). Judgment on the award may be entered in any court with jurisdiction. ◦ Class Action Waiver: All proceedings shall be on an individual basis only. You waive any right to class, consolidated, or representative actions. ◦ Arbitration Fees: Each party bears its own costs, except as provided by AAA rules or applicable law. ◦ Opt-Out: You may opt out of arbitration within 30 days of first accepting these Terms by sending written notice to: Tenant Waiting List LLC, c/o WealthWise Realty & Management, LLC, brokered by Exzel Realty LLC, 7400 N Oracle Road Suite 150-125, Tucson, AZ 85704, Attn: Robert Becker, email: Robert@TenantWaitinglist.com. • This section survives termination and is enforceable under Arizona and federal law.
10. Force Majeure Neither party is liable for delays or failures to perform (except payment obligations) due to events beyond reasonable control (e.g., acts of God, pandemics, government orders, strikes). The affected party must notify the other and use reasonable efforts to mitigate.
11. Changes to Terms We may update these Terms. Continued use after the updated Effective Date constitutes acceptance. We encourage periodic review.
12. Miscellaneous • Entire Agreement: These Terms, together with our Privacy Policy and any separate placement agreements, constitute the full agreement. • Severability: If any provision is invalid, the remainder remains in effect. • No Waiver: Failure to enforce a right does not waive it. • No Agency: Nothing creates an agency, partnership, or joint venture relationship. • Equal Housing Opportunity: We are an Equal Housing Opportunity provider. We comply with all fair housing laws.
